1. Who we are

1.1 This online shop at fortavel.com is operated by CR OU OÜ, Nõmme tee 64-3, 11311 Tallinn, Estonia, registry code 16778262, VAT ID EE103034274 ("we", "us"). Contact: [email protected].

1.2 These Terms and Conditions apply to all orders placed by consumers in our online shop. A consumer is any natural person who buys for purposes that are mainly outside their trade, business or profession.

1.3 We sell only to adults. By placing an order you confirm that you are at least 18 years old.

2. Products

2.1 Fortavel is a food supplement. It is not a medicinal product and is not intended to diagnose, treat, cure or prevent any disease. Please read the Health Disclaimer before use.

2.2 The essential characteristics of each product (ingredients, quantities, recommended daily dose, warnings) are shown on the product page and on the label. Images are illustrative; the label on the product you receive prevails.

3. How a contract is concluded

3.1 The presentation of products on our website is not a binding offer but an invitation to order.

3.2 You place a binding order by completing the checkout and clicking the button "Order with obligation to pay" (or equivalent wording in your language). Before you do so, you can review and correct all your details on the order summary page.

3.3 We confirm receipt of your order by email immediately. The contract is concluded when we accept your order, either by sending a separate order confirmation or by dispatching the goods, at the latest within two business days.

3.4 The contract language is the language of the website version you used. We store the contract text and send you these Terms and Conditions with the order confirmation.

4. Prices and one-time purchase

4.1 All prices are final prices in EUR and include the VAT of your country of delivery. Shipping within the markets we serve is free unless stated otherwise at checkout.

4.2 Every order is a one-time purchase. There is no subscription and no recurring payment. You are charged only once for the order you place. You decide if and when to order again.

4.3 Where we show a reduced price, the reference price shown is the lowest price we charged for the same product in the 30 days before the reduction, in line with Directive 98/6/EC as amended by Directive (EU) 2019/2161.

5. Payment

5.1 You can pay with the methods offered at checkout, currently: credit and debit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, PayPal, Klarna.

5.2 Payments are processed by licensed payment service providers. We never see or store your full card details.

5.3 Payment is due when you place the order. For "pay later" methods (such as Klarna), the payment terms of that provider apply.

6. Delivery

6.1 We deliver to the countries listed at checkout. Orders are dispatched within 1-2 business days and usually arrive within 2-5 business days. Full details are in our Shipping Policy.

6.2 The risk of accidental loss or damage passes to you only when the goods are delivered to you or to a person you have designated.

6.3 If a parcel is refused, not collected or undeliverable because of incorrect address details, the rules in our Returns and Refunds Policy apply, including the deduction of the actual return and handling costs up to €19.95.

6.4 If a product is unexpectedly unavailable, we will inform you immediately and refund any payment already made within 14 days.

7. Right of withdrawal

7.1 As a consumer you have a statutory right to withdraw from the contract within 14 days without giving any reason. The details, including the model withdrawal form, are set out in our Returns and Refunds Policy, which forms part of these Terms and Conditions.

7.2 For reasons of health protection and hygiene, the right of withdrawal expires for sealed goods once the seal has been removed after delivery (Article 16(e) of Directive 2011/83/EU).

7.3 Independently of the statutory right, we offer a voluntary 30-day satisfaction guarantee (section 8).

8. 30-day satisfaction guarantee

8.1 If you are not satisfied with Fortavel, you can ask for a refund within 30 days of delivery.

8.2 The guarantee covers 1 opened pack per customer, including an empty one, and all remaining packs of the same order returned sealed and unused.

8.3 To use the guarantee, contact [email protected] before sending anything back. We will send you the return instructions. We refund the purchase price of the returned packs, minus a handling fee of €19.95 per return, within 14 days of receiving them, using the original payment method. The cost of sending the goods back is borne by you, unless the goods are faulty or we made a mistake.

8.4 This guarantee is in addition to, and does not limit, your statutory rights.

9. Statutory warranty

9.1 You are entitled to the statutory rights for goods that do not conform to the contract. Under Estonian law, we are liable for any lack of conformity that becomes apparent within two years of delivery.

9.2 If a product arrives damaged or incorrect, please tell us within a reasonable time, ideally within 7 days, with a photo, so that we can replace it or refund you quickly. Reporting later does not affect your statutory rights.

10. Liability

10.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under mandatory product liability law.

10.2 For slight negligence we are liable only for the breach of essential contractual obligations and limited to the foreseeable damage typical for the contract.

10.3 We are not liable for damage caused by use of the product contrary to the label, the recommended daily dose or the warnings.

11. Complaints and disputes

11.1 Send any complaint to [email protected]. We reply within one business day and aim to resolve every issue within 15 days.

11.2 If we cannot agree, you can contact the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon), Consumer Protection and Technical Regulatory Authority, Endla 10a, 10122 Tallinn, Estonia, www.ttja.ee, or the European Consumer Centre in your country.

12. Applicable law and jurisdiction

12.1 These Terms and Conditions are governed by the laws of the Republic of Estonia. As a consumer, you also keep the protection of the mandatory provisions of the law of the country where you have your habitual residence (Article 6 of Regulation (EC) No 593/2008).

12.2 You may bring proceedings in the courts of your country of residence or in Estonia.

13. Final provisions

13.1 If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions is not affected.

13.2 We may update these Terms and Conditions for future orders. The version valid at the time of your order applies to that order.
